This assignment required a critical discussion and legal evaluation of information management, privacy, and confidentiality within sexual assault counselling services. It also included a review of tortious liability and the protection that good information handling provides for counsellors and their employers. Additionally, it required analysis of the criminal trial process, with emphasis on compellability and the disclosure of confidential information. These objectives were addressed through application of relevant legislation such as the Privacy Act 1988 (Cth), Evidence Act 1995 (NSW), and professional codes of ethics. Tort law principles such as negligence and duty of care were discussed in relation to potential liability. The work used hypothetical case scenarios and real legal precedents to illustrate legal risks and protective practices. The rules governing criminal procedure in sexual assault cases were also critically evaluated in light of confidentiality exceptions, client rights, and evidentiary protections.
